Pelindungan Hukum Hak Cipta Terhadap Penyebaran Film Korea Yang Diakses Melalui Aplikasi Telegram Dintinjau Dari Undang-Undang Hak Cipta

Abstract

Film is a tool to convey various messages to the general public through artistic expression media to express ideas and story ideas through creative works that originate from the creations of human reason and intellect that give birth to a right called copyright. Along with the development of information technology, films are not only shown in cinemas, but can also be distributed through accounts such as the Telegram application.. The formulation of the problem raised in this thesis is How is the form of copyright infringement by Telegram application users against the illegal distribution of Korean films accessed through the Telegram application, What are the legal consequences for copyright infringement by Telegram application users against the illegal distribution of Korean films reviewed from Law Number 28 of 2014 concerning Copyright, and How the legal protection of copyright holders against the dissemination of Korean films accessed through the Telegram application is reviewed from Law Number 28 of 2014 concerning Copyright.The method used in this study is normative legal research with the nature of this research as analytical descriptive research. The data source used is secondary data. The data collection technique is a literature study. The data collection tools used are interviews and documentation studies. This research approach uses a legislative approach and a comparative approach. The results of this study regarding the form of copyright infringement by Telegram application users against the illegal distribution of Korean films as regulated in Article 40 paragraph 1 of Law Number 28 of 2014. The legal consequences for Telegram users who distribute films illegally are a violation of Copyright which causes material and immaterial losses for the Creator, or Copyright Holders of their creative works. Legal protection of copyright holders against the distribution of Korean films accessed through the Telegram application is reviewed from Law Number 28 of 2014 concerning copyright, namely through cooperation between Indonesia and South Korea in copyright protection.
