This research discusses the evidence in a breach of contract lawsuit concerning the Cherry Slim product sales cooperation agreement between CV Albaruni Sukses Bersinar and Nonik Ayu Widya Putri, analyzed through the Klaten District Court Decision No. 105/Pdt.G/2022/PN Kln. The agreement originated from a collaboration to produce and distribute Cherry Slim products, but a dispute arose, leading one party to file a breach of contract lawsuit. The study aims to analyze the legal basis for determining breach of contract in the agreement, the strength of electronic evidence in the lawsuit, and the judicial considerations in deciding the case.
In this thesis, the normative research method was employed, involving a literature study using primary, secondary, and tertiary legal materials. The analysis method used is qualitative analysis, along with a case law and statutory approach.
The findings conclude that the electronic evidence used did not fulfill the requirements for valid evidence under the Electronic Information and Transactions Law (EIT Law), resulting in the partial granting of the breach of contract lawsuit.
Determining Breach of Contract: Based on the analysis of Decision No. 105/Pdt.G/2022/PN Kln, it was found that breach of contract occurs due to one party's failure to fulfill contractual obligations.
Validity of Electronic Evidence: Screenshots presented by the plaintiff were not recognized as strong evidence in court because they did not meet the valid electronic evidence standards under the EIT Law. This demonstrates that in civil litigation, admissible evidence must comply with the applicable legal provisions.
Evaluation of Judicial Considerations and Decision: Although the screenshot evidence was inadmissible, the judge considered the defendant's acknowledgment regarding payment authorization as a basis for declaring the defendant in breach of contract. The judge’s decision was based on valid evidence and the defendant's admission during the trial.
