Urgensi Pelindungan Hukum Atas Karya Kreatif yang Lahir dari Penggunaan Artificial Intelligence di Indonesia dan Relevansinya dengan Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta

Abstract

The creation of creative works using artificial intelligence technology poses a serious threat towards the existence and invention of digital copyright works in the field of Intellectual Property Rights, such as increased risk, forgery of works theft of someone’s ideas, and other copyright violations. This research discusses three issues, namely: 1. How are the legal regulations regarding artificial intelligence in Indonesia? 2. How is the legal protection for creative works in the field of Intellectual Property Rights in Indonesia in the current digital era? 3. What is the urgency of legal regulation of creative works arise from the ose if artificial intelligence and its relevance to Law No. 28 of 2024? This research uses normative legal research method with a legislative approach, legal concepts, cases, and legal comparisons. This is a prescriptive research. The primary legal material uses in Law Number 28 of 2024 concerning Copyright. The secondary legal material is in the form of legal literature regarding the creation of creative works in the field of Intellectual Property Rights in the use of artificial intelligence. The research result emphasize the importance of carrying out legal reviews to provide legal protection as the urgency for the formation of new regulations for users of Artificial Intelligence in the creation of creative works in Indonesia. The conclusion of this research is that the urgency of legal regulation of creative works arises from the use of artificial intelligence and its relevance to Law N0. 28 of 2014 can be viewed based on developments in technological science, digital works which create emptiness and legal uncertainty, especially for art works who create creative works in the use of Artificial Intelligence.
