Analisis Yuridis Dikabulkannya Perkawinan Beda Agama (Studi Penetapan No.141/Pdt/.P/2023/PN Yk)

Abstract

The objective of the research is to find out the acceptance of a mixed marriage. Marriage is defined as physical and emotional bond between a man and a woman in order establish a happy and everlasting family. Based on the almighty God. This explanation includes a close relationship between a marriage and religion in wich religion organizes marriages according to their belief and promotes the united faith in wedlock. The research uses juridicial normative research method with descriptive approach. Statue approach, and case approach, supported by primary, secondary, and tertiary legal materials while the data are gathered by conducting the mixed marriage which becomes a complex issue in the indonesian pluralistic society. It also becomes a challenge for married couples who have different religion. In this case, The Yogyakarta District Court Verdict No.141/Pdt.P/2023/PN Yk can become an example of the case in wich the court accepts the request for a mixed marriage with arouses various reactions in Indonesia. The objective of the research is to analyze the juridicial aspect, the Verdict, and its effect on understanding law on marriage in Indonesia. Therefore, this research provides the insight about the dynamics of marriage law in Indonesia, either from the religious perspective or from human rights.
