dc.description.abstract | Thrifting refers to the act of shopping at places such as thrift stores, flea markets, or rummage sales, where individuals can find used items at more affordable prices. The role of social media in connecting sellers and buyers of thrifting shoes is very significant. Apart from that, social media also facilitates individuals and online stores to promote their thrifting shoe collections, thereby creating a wider community around these used items. The majority of Indonesian people classify thrifting products as including used clothing, factory defective clothing, and imported clothing. The aim of this research is to discuss regulations regarding the completeness of product information regarding the sale of thrifting shoes online via social media Instagram. According to positive law in Indonesia, the responsibility of business actors for the completeness of thrifting shoe product information via social media Instagram according to positive law in Indonesia and legal efforts to request responsibility of business actors for the completeness of thrifting shoe information via social media Instagram in Indonesia.
The type of research carried out in this research is a combination of normative juridical and empirical juridical. Research is carried out by reviewing and analyzing existing library materials such as legislation, expert views, legal doctrine and related legal systems. This research has a descriptive nature that reveals the relationship between existing laws and regulations and the legal theories that are the focus of the research. The data collection technique used uses library data collection and field data.
Regulations regarding the completeness of product information for the sale of thrift shoes on Instagram social media according to Indonesian Positive Law are regulated in Law Number 11 of 2008 concerning Information and Electronic Transactions, Article 9 of the ITE Law, Article 7 of Law No. 8/1999, Article 65 paragraph (1) Law no. 7/2014. These articles emphasize that providing complete product information is an obligation that must be carried out by business actors and is the right of buyers. Forms of violations committed by business actors regarding the completeness of information regarding the sale of thrifting shoes via Instagram social media generally occur when sellers or business actors do not pay attention to these terms and conditions as one of the important things in giving trust to consumers. This responsibility is regulated in Article 19 of the Consumer Protection Law, as well as in Article 62 in conjunction with paragraph (1) Articles 8 and 9 and 17 of the Consumer Protection Law. There are several channels or efforts to seek accountability through non-litigation channels, namely arbitration, negotiation, mediation and conciliation. The limited evidence in consumer disputes selling thrift shoes on social media is due to the existence of features on social media that can re-edit this information. | en_US |
