Perlindungan Hukum terhadap Penumpang Pesawat Terbang yang Mengalami Kehilangan Barang Bagasi Kabin dalam Penerbangan (Studi Putusan Nomor 117PK/Pdt.Sus-BPSK/2017)

Abstract

Airplanes have luggage, often the luggage carried by passengers carried by airlines is lost or damaged, such as in the case of Leo who lost valuables in a bag placed in the cabin while traveling from Geneva to Jakarta using Qatar Airways. This thesis is entitled "Analysis of Legal Protection for Airplane Passengers Who Experience Loss of Cabin Baggage on a Flight (Study of Decision Number 117PK/Pdt.Sus-BPSK/2017)". The problem formulation is: 1) What are the legal protection regulations for passengers who experience loss of cabin baggage on a flight; 2) What are the responsibilities of airlines in providing legal protection to passengers for lost cabin baggage during flights; 3) What is the analysis of the judge's considerations and decisions in providing legal protection to passengers who experience loss of cabin baggage on flights in the Supreme Court Decision Number 117PK/Pdt.Sus-BPSK/2017) The method used in this thesis is normative juridical research and is descriptive analytical. This research uses a statutory approach and a case study approach. The data source is only secondary data and the data will be analyzed using a deductive conclusion drawing method The research results found that legal protection for passengers who lose cabin baggage and compensation for in-flight losses are regulated in Law no. 1 of 2009 concerning Aviation in Articles 143 and 144 and Minister of Transportation Regulation No. 77 of 2011 concerning Air Carrier Responsibilities. The form of liability that can be provided by the airline is by paying compensation in the amount of actual losses experienced by the passenger, however the passenger must be able to prove that the loss of the luggage was the fault of the airline employee. The government should make regulations regarding how to prove damage/loss of passenger cabin baggage
