Kedudukan Akta Kelahiran Bagi Anak Yang Lahir dari Hasil Perkawinan Sirri (Studi Di Dinas Kependudukan Dan Pencatatan Sipil Kabupaten Labuhanbatu Utara)

Abstract

A birth certificate is a right for every child. Every child has the right to receive a birth certificate, therefore even fathers and mothers who are in unregistered marriages have children's rights protected by the state. People who want to arrange a birth certificate can come directly to the Dukcapil office or arrange it online. If the parents are not legally married then the birth certificate will contain a phrase stating that the child born from the marriage has not been registered. The formulation of the problem in this thesis is how to register birth certificates for children resulting from unregistered marriages after the enactment of Law Number 24 of 2013 concerning Population Administration and Minister of Home Affairs Regulation Number 109 of 2019 concerning Forms and Books used in Population Administration in North Labuhanbatu Regency, what are the rights of those born as a result of a sirri marriage with the issuance of birth certificates in North LabuhanBatu Regency, what is the role of the Population and Civil Registration Service of North Labuhanbatu Regency in registering Birth Certificates for children resulting from sirri marriages. The research was conducted using normative juridical research supported by empirical juridical data and this research is descriptive analytical, namely research that aims to describe a situation or symptom or to determine whether there is a relationship between a symptom and another symptom. The data collection techniques used were literature study and field study. H The results of the research and discussion show that the mechanism for registering birth certificates for children resulting from unregistered marriages at the North Labuhanbatu Population and Civil Registration Service office is not fully guided by Law no. 24 of 2013 (Concerning Population Administration) and Minister of Home Affairs Regulation No. 109 of 2019. The rights that arise for children resulting from unregistered marriages with the issuance of birth certificates in North Labuhanbatu Regency after the Constitutional Court decision No. 46/PUU-VIII/2010 have been provide a decision that guarantees the fulfillment of civil rights for a child resulting from an unregistered marriage. The role of the Population and Civil Registration Service of North Labuhanbatu Regency in registering Birth Certificates for children resulting from sirri marriages is not to differentiate the issuance of birth certificates for children resulting from sirri marriages from birth certificates for children in general. The difference here is only the documents submitted as a condition for issuing birth certificates.
