Peran dan Fungsi Kejaksaan Bidang Intelijen dalam Melakukan Penyuluhan Hukum Kepada Masyarakat Serdang Bedagai (Studi pada Kejaksaan Negeri Serdang Bedagai)

Abstract

This study will focus on the role and function of the Serdang Bedagai District Attorney's Office Intelligence Division in providing legal education to the community in Serdang Bedagai. Based on the Attorney General's Law, both Law No. 16 of 2004 and Law No. 11 of 2021 as the legal basis for the institution of the Republic of Indonesia Attorney General's Office to carry out its main tasks and functions. In addition, internal regulations on the Organization and Work Procedures of the Republic of Indonesia Attorney General's Office as referred to in the Regulation of the Attorney General of the Republic of Indonesia No. PER-006/JA/07/2017 also do not find the main tasks and functions of the intelligence division of the attorney general in providing legal education. Therefore, this study is important to be carried out, to find out where the legal basis for the task of legal education of the attorney general's intelligence division is. Based on the above, the problems in this research are as follows: First, the regulation of legal education in the framework of the criminal policy of the Republic of Indonesia Attorney General's Office; Second, the role and function of the Serdang Bedagai District Attorney's Office Intelligence Division in providing legal education to the community; and Third, the obstacles and efforts made by the Serdang Bedagai District Attorney's Office Intelligence Division in providing legal education to the community in Serdang Bedagai Regency. The research method used is normative legal research with an empirical approach. The data source as primary legal material is the results of interviews conducted with informants, namely: the Head of the Intelligence Section of the Serdang Bedagai District Attorney's Office. Analysis of the source of legal material is done qualitatively, and the conclusion is drawn with deductive-inductive reasoning. The research results indicate that: First, the Prosecution Law does not contain the norm of "legal counseling" but rather emphasizes "increasing legal awareness of the community" in accordance with Article 30 paragraph (3) letter a of the Prosecution Law 2004. Second, the role of the Serdang Bedagai District Attorney's Office in the Intelligence Division in providing legal counseling is a "social role" in carrying out the "control function" based on the Regulation of the Attorney General of the Republic of Indonesia concerning the Organization and Work Procedures of the Public Prosecutor's Office. Third, there are substantial, structural, and cultural obstacles faced by the Serdang Bedagai District Attorney's Office in the Intelligence Division, along with the efforts made. Therefore, it is recommended to at least create technical guidelines for legal counseling at the local district attorney level.
