The function of regional regulation formation/legislative function of the DPRD has formal legal legitimacy based on Article 18 Paragraph (6) of the 1945 Constitution of the Republic of Indonesia, which states that “Regional Governments have the right to establish regional regulations and other regulations to implement autonomy and assistance duties.” Additionally, the enactment of Law Number 23 of 2014 on Regional Government and Law Number 17 of 2014 on the MPR, DPR, DPD, and DPRD is expected to make the DPRD more active and productive in actualizing its regional regulation formation/legislative function. However, the function of regional regulation formation in the DPRD of North Sumatra Province, as the subject of this study, is not optimally executed as prescribed by the law.
The objective of this study is to understand and analyze the implementation of the regional regulation formation function in the DPRD of North Sumatra Province for the 2019-2024 period and to understand and analyze the process of forming regional regulations in North Sumatra Province. This research uses a normative juridical method with an approach that involves reviewing all laws and regulations related to the legal issues addressed. Therefore, this study involves analyzing theories related to the Implementation of the Regional Regulation Formation Function in the DPRD of North Sumatra Province in the formation of regional regulations based on relevant literature and applicable legislation.
The research findings indicate that the DPRD of North Sumatra Province has not yet been able to optimally perform the function of forming regional regulations. This is evidenced by the minimal proposals/initiatives for draft regional regulations from the DPRD. Furthermore, the function of forming regional regulations is often carried out in a conventional manner that still resembles practices before the implementation of broad autonomy, which is generally passive.
