The influence of the internet in Indonesian society continues to increase along with the large number of users or via computers, smartphones, tablets and other mobile devices. The growing emergence of the internet has brought and presented new methods or new systems to communicate and obtain information very easily and quickly. The use of technology known as electronic media has reached a stage where it is easy to spread news in just a matter of seconds and can even spread the news on a fairly large scale. The easy spread of news can also result in the easy spread of fake news, known as Hoax.
The police is one of the government institutions that plays a very important role in law enforcement policies against fake news (Hoax) crimes. Article 30 paragraph 4 of the 1945 Constitution states that the National Police is an instrument of the State which maintains security and order and is tasked with protecting, protecting, serving the community and enforcing the law. The North Sumatra Regional Police's duties in enforcing the law in accordance with the 1945 Constitution can be preventive, namely preventing,and repressive, namely taking action. The regulation of criminal acts of fake news (Hoax) according to Indonesian law is contained in Article 378 of the Criminal Code (KUHP), Article 14 paragraphs (1) and (2) and Article 15 of Law No. 1 of 1946 concerning Legal Regulations Criminal law, as well as in Article 28 paragraph (1) of Law Number 11 of 2008 in conjunction with Article 45A of the Electronic Transaction Information (ITE) Law Number 19 of 2016. The North Sumatra Regional Police carries out investigation and hoax mechanisms in accordance with with the procedures regulated in the Criminal Procedure Code. In its implementation, the North Sumatra Regional Police have carried out various efforts and experienced obstacles in investigating and investigating fake news (hoaxes).
