The 1999 Montreal Convention and national laws, including Law Number 1 of 2009 concerning Aviation, provide a legal basis for airlines' responsibilities to passengers. However, its implementation still faces obstacles in providing maximum protection to consumers. The formulation of the problem is, how is the legal regulation for passengers for the loss and damage of luggage on air airlines according to the 1999 Montreal Convention and national laws, what is the impact of the loss and damage of luggage on air airlines according to the 1999 Montreal Convention and national laws, and how is the implementation of consumer protection for passengers for the loss and damage of luggage on air airlines based on the 1999 Montreal Convention and national laws
The type of research applied is using a descriptive research method with a normative legal form (normative legal research). The data sources used are primary, secondary and tertiary data. Data collection techniques are carried out through library research. Data analysis in this study was carried out qualitatively.
Based on the results of the author's research, the legal regulations regarding airline liability for loss and damage to passenger luggage have been comprehensively regulated through the Montreal Convention 1999 and supported by national laws such as Law Number 1 of 2009 concerning Aviation, which provides protection and legal certainty for passengers. This regulation sets the limits of airline liability and procedures for claims for compensation for loss and damage to luggage that have material and psychological impacts. Incidents such as this also have the potential to reduce trust in airline services and tarnish the reputation of the aviation industry. However, the implementation of this regulation still faces challenges in the field. The claim submission process is often considered complicated and time-consuming. Therefore, efforts are needed to increase the effectiveness of the implementation of the rules by simplifying claim procedures, increasing transparency, and strengthening supervision of airline compliance. | en_US |
