Verbal Sexual Harassment (Catcalling) A Study from the Aspects of Criminal Law and Criminology in Indonesia
Abstract
Catcalling is a form of sexual harassment in public spaces that involves whistling, teasing with derogatory calls, or comments on the physical appearance of unknown women, which tend to be sexually oriented and visually stimulating. Catcalling is not just shouting or whistling, but also contains symbols and gestures used to harass the victim. These symbols are intended to tease or disturb, and demean the victim. With the development of technology, verbal sexual harassment can not only occur in public places and places, but also on social media through various platforms such as Instagram, Facebook, Twitter, WhatsApp, Line, TikTok, etc. Indonesian law, especially the Criminal Code, does not clearly regulate verbal sexual harassment.
The problems that will be discussed in writing this thesis are how the regulation related to the crime of verbal sexual harassment in criminal law in Indonesia, how the phenomenon of verbal sexual harassment (catcalling) is currently occurring in Indonesia, and how legal protection is guaranteed for victims of verbal sexual harassment (catcalling). The method used in this study is normative legal research which is also called theoretical legal research which examines based on the provisions of laws and regulations, journals and expert opinions. Based on the results of the analysis of all phenomena of verbal sexual harassment actions along with the provisions in providing legal protection for victims analyzed by the author, it can be concluded that verbal sexual harassment (catcalling) is indecent and unlawful behavior that is carried out by forcing sexual elements on someone without their consent. This behavior can be in the form of speech, touch, or other actions of a sexual nature. Sexual harassment often occurs in public spaces, especially against women, and can make them feel intimidated and unsafe. Efforts to provide legal protection for victims of verbal sexual harassment (catcalling) are carried out by providing medical rehabilitation, mental and social rehabilitation, social empowerment, restitution and/or compensation; and social reintegration.
