Abstract

Indonesia has a large workforce and the state must provide guarantees of legal certainty and legal protection as long as these workers become workers or after entering retirement age. BPJS Employment is a form of providing guaranteed protection to workers. The BPJS Employment branch has been established in Padangsidimpuan City since 2013. In the process of carrying out claims, there are still several obstacles experienced by workers, starting from a lack of understanding of the online claim method provided by BPJS Employment to several problems with incorrect data between the BPJS Employment server and the participants' accounts, the long queuing process for claims at branches which takes a long time for participants to make BPJS Employment claims. This research is normative legal research that is descriptive analysis. The type of data used consists of primary, secondary and tertiary legal materials collected using library study techniques and supported by empirical data from interviews, conducted with sources from BPJS Employment to confirm the data. Next, it was analyzed using a qualitativenormative data analysis method. This research concludes that there are still a number of problems in the BPJS Employment claims process in Padangsidimpuan City. In the old-age insurance and pension guarantee programs, there are still several obstacles experienced by workers, starting from a lack of understanding of the online claim method provided by BPJS Employment, problems with incorrect data between the BPJS Employment server and participants' accounts, the long queuing process for claims which takes time It takes a long time for participants to make BPJS Employment claims. providing legal certainty in BPJS Employment claims based on Law No. 60 of 2015 on old age insurance and Law No. 45 of 2015 on pension guarantees. The concept of economic analysis of law aims to ensure that BPJS Employment participants who receive claims receive legal guarantees that have used analysis. in accordance with the concepts in economics itself in accordance with the contents of article 33 of the 1945 Constitution.
