Kemudahaan Berinvestasi di Ibu Kota Nusantara Berdasarkan Peraturan Pemerintah No. 12 Tahun 2023

Abstract

This reseacrh aims to determine and describe the concept of ease of investment and strategies to achieve it in Indonesia, the elaboration of the concept of ease and certainty of doing business in the Indonesian Capital City (IKN) based on Government Regulation No. 12 of 2023 and legal protection for investors who invest their capital in IKN based on Government Regulation No. 12 of 2023 and other related regulations. The research method used is a descriptive normative legal research method. Library research to obtain primary, secondary, and tertiary legal materials related to the problems discussed. All data were analyzed using qualitative normative data analysis methods. Based on the results of the data analysis, it was concluded that investment is one of the main instruments or factors to spur economic growth and development in Indonesia, including in the IKN region. The concept of ease of investment in Indonesia is regulated in Law Number 25 of 2007 in the form of ease of business licensing, ease of investment in providing incentives, ease of investment in providing facilities. Government Regulation No. 12 of 2023 provides the concept of ease and certainty of doing business in investment activities in the form of ease of business licensing, ease of doing business, and investment facilities for business actors in the IKN. Government Regulation No. 12 of 2023 and other related legal regulations also provide legal protection for investors in a preventive and repressive manner in protecting and guaranteeing ease and investment activities in the IKN.
