The presence of imported second-hand clothing significantly disrupts the
domestic market, which serves as the primary market for small industries and
garment businesses. Medan City is known as one of the major markets that trade a
substantial amount of imported second-hand clothing. This study aims to analyze the
legality of imported second-hand clothing trade and the legal protection provided to
consumers in the second-hand clothing trade at Pasar Melati, Medan City.
This research employs a combination of normative legal research and
empirical legal research with a descriptive-analytical approach. Secondary data in
the form of legal materials were collected through library research, while supporting
empirical data were obtained through interviews. All data were analyzed using
gualitative data analysis methods.
The study concludes that the trade of imported second-hand clothing is
illegal, as the importation of used goods is explicitly prohibited by the government
under Minister of Trade Regulation No. 51/M-DAG/PER/7/2015 on the Prohibition
of Importing Used Clothing. Legal protection for consumers of imported second-
hand clothing remains suboptimal due to the lack of clear regulations governing this
trade, which leaves consumers without legal certainty. Moreover, consumer
protection in the second-hand clothing trade at Pasar Melati, Medan City, remains
unregulated, as no specific legal provisions address the protection of consumers
purchasing imported second-hand goods.
