Divorce from a Gender Perspective (Case Study: Women’s Motives for Sueing Divorce Against Their Husbands in Mebidang)
Abstract
This divorce phenomenon has become a phenomenon that has been discussed a lot in recent years, especially in cases of contested divorce. Contested divorce is the main topic in divorce cases, because there is quite a high inequality between contested divorce and talak divorce in Indonesia. It is considered that divorce is the last resort taken by women. There are two aims of this research, namely to find out what motives underlie women to sue their husbands for divorce and to find out what form of gender injustice women receive. This research uses a qualitative descriptive method with a case study approach. The data collection used was observation, interviews and documentation. The informant in this study was a woman who sued her husband for divorce which was legally registered in the religious court in MEBIDANG. The results of the research show that single women in MEBIDANG interpret divorce as a form of final solution, and there are many motives for suing their husbands for divorce. There are 3 main factors that are dominant among women who sue their husbands for divorce in MEBIDANG, namely women who are exposed to a double burden, acts of violence in the household and the last is seeking peace and security in the household. The strong patriarchal culture in society makes women experience a lot of pressure to file for divorce from their husbands, one of which is to maintain the good image of the family name.
