Abstract

This research is based on Sexual Deviation consisting of two syllables, namely deviation and sexual. Deviation comes from the basic word "intersection" which has four meanings. First, it means a process, namely a way of doing something that is deviant or deviant. Second, it means turning or taking another path. Hypersexual can also be pinned on people who have sex with a higher intensity than normal people, or people who too often imagine sex through fantasy. The formulation of the problem in this study is How is the Regulation of Criminal Acts of Abuse due to hypersexual behavior According to the Criminal Code and Islamic Criminal Law? How is the Responsibility of Perpetrators of Abuse due to hypersexual behavior According to the Criminal Code and Islamic Criminal Law? How is Legal Protection for Victims of Criminal Acts of Abuse due to Hypersexual behavior According to the Criminal Code and Islamic Criminal Law? The results of the discussion in this study are In the context of law in Indonesia, abuse is regulated in the Criminal Code (KUHP), especially in Articles 351 to 356. The Criminal Code categorizes abuse into several levels, namely light, moderate, to severe abuse. However, the provisions in the Criminal Code do not specifically discuss certain psychological conditions, such as hypersexuality, which can influence the motive or cause of abuse. Meanwhile, in Islamic criminal law In Islamic criminal law, abuse is a form of violation of human rights that are upheld in Islam. Islam views that every human being is responsible for their actions, so that acts of abuse caused by excessive sexual urges are considered a form of the perpetrator's inability to maintain morals and ethics in accordance with religious teachings.
