The position of political parties is central which means that they become the
pillars of democracy in the Indonesian political system. A political party is
established based on its vision, mission, and ideology in obtaining constitutional
legitimation of power. The power is realized by the existence of its role in the
members of DPR RI (Indonesian Parliament) concerning the legislation function
carried out by them in a fraction based on the confederation of the result of general
election. The involvement of a political party is closely related by the members of
DPR RI; it can be seen from the authority of its political leader who has the authority
to establish the fraction and to formulate and determine the policy on Official
Political Course of the Nation. Therefore, in the political infrastructure, a political
party has political domination upon the members of DPR RI who are in the political
suprastructure.
The research uses juricical normative method, based on conceptual and statute
approach. The data consists of secondary data which materials are obtained from
literature, and primary data are gathered of through juridical approach based on
laws according to the available research variables.
The result of the research shows that the position of a political party in the
Political System of the Republik of Indonesian is functioned as a democratic actor
established by the people on the same ideology in doing its function as a political
party. It is evident that the role of a political party in the Indonesian political system
is through the recruitment pattern and cadre formation done by political party
toward its members in order to make them qualified and to prepare them to be
nominated as the legislative members in the general election. Therefore, by the role
and the function of the members DPR RI in the establishment of law, its relevance to
its membership in the political party is based on its vision, mission, and policy
direction. The establishment of a Bill cannot be separated from the authority of the
general chairperson of a political party. This is based on the legal consideration of a
political party which function is to formulate the policy of the nation. It means that
the policy of the nation is made in the form of law as a part of the legislative function
of the members of DPR RI.
