| dc.description.abstract | The rapid development of social media has given rise to various crimes, one of which is revenge porn. The factors that lead someone to commit revenge porn crimes through social media can be seen from criminological theories. The relationship between criminology and criminal law is an inseparable unity in its implementation. This thesis addresses several research questions, as follows: 1) How does criminal law regulate the crime of revenge porn? (Revenge Porn) According to Positive Law; 2) What are the Causes of the Crime and Factors of Revenge Pornography (Revenge Porn) on Social Media 3) How to Conduct Legal and Criminological Analysis in Cases of Revenge Pornography (Revenge Porn) in Judgment No. 17/Pid.B/2024/PN Son, Judgment No. 594/Pid.B/2024/PN Bjm, and Judgment No. 774/Pid.B/2022/PN Blb. The research method used in this thesis is a normative legal research method that utilizes secondary data obtained from primary, secondary, and tertiary legal sources. The data analysis used in this study is qualitative analysis. The factors of revenge porn are internal factors consisting of psychological factors, sexual satisfaction, lack of empathy, and dehumanization, and external factors consisting of economic factors, family factors, relational factors, patriarchal cultural factors that are still deeply ingrained in the surrounding community, and technology. In this study, it can be concluded that the factors causing perpetrators to commit revenge porn crimes on social media in court decisions No. 17/Pid.B/2024/PN Son, No. 594/Pid.B/2024/PN Bjm, and No. 774/Pid.B/2022/ PN Blb, the factors include external and internal factors that led the perpetrators to commit revenge porn crimes, such as revenge due to heartbreak, which is an internal factor within the perpetrator, and an unhealthy relationship between the perpetrator and the victim, which made it easier for the perpetrator to commit revenge porn crimes. All segments of society need to be educated about the legal and social consequences of participating in digital sexual activities to prevent the abuse of trust that can lead to revenge porn crimes. | en_US |
