This study was conducted to determine the relationship between marriage customs and divorce decisions in Pasar Sibuhuan Village. The purpose of this study was to describe and analyze why the high divorce rate occurred in Pasar Sibuhuan Village, Padang Lawas Regency. The reason the author conducted this study was because in general, the people in Sibuhuan who are still thick with their customs and religion still have many husbands and wives who experience family problems and end in divorce.
The method used in this study is a qualitative method using data collection techniques in the form of interviews and documentation which aims to obtain comprehensive results regarding the actual conditions in the field regarding the relationship between marriage customs and divorce decisions in society.
The results of this study indicate that divorces that occur in Pasar Sibuhuan Village cannot be separated from customary law. Divorce in Pasar Sibuhuan Village shows that the most divorce cases occur in married couples whose marriage customs are not ideal, namely in the marlojong marriage process (elopement). However, the completeness of the implementation of marriage customs is not the only factor causing divorce cases, because the results of the study show that divorce can occur due to internal factors of the couple such as husbands being addicted to drugs, infidelity, online gambling, domestic violence and others.
The results of the study also show that the mechanism for resolving divorce problems tends to be implemented in customary mechanisms (hatobangon institutions), rather than through religious court institutions. The choice of this mechanism is in accordance with local customary rules where marriage and divorce issues become the business of customary institutions (hatobangon), because they marry starting with custom and ending with custom too.
