Analisis Hukum Internasional Terhadap Perlindungan Hak Asasi Atlet: Studi Kasus Dugaan Diskriminasi Imane Khelif pada Kejuaraan Dunia 2023 dan Olimpiade Paris 2024

Abstract

Along with the increase of participants in international sports events, especially among the female athletes, makes it necessary to pay critical attention to the regulations of international sports federations in order to ensure inclusivity for female athletes. Although international sports federations and international law have prohibited any act of discrimination, as stated in various international law instruments as well as the regulations of the International Olympic Committee and the International Boxing Association, in reality, acts of discrimination against athletes still occur until this moment. This study analyses the case of alleged discrimination experienced by Algerian boxer, Imane Khelif, who was disqualified from the semi-finals of the World Boxing Championship 2023 on controversial grounds and allegedly containing elements of discrimination based on gender or sex variations. The research methods used are normative juridical and descriptive analytical with a legislative approach method, and the data collection techniques used are in the form of literature studies and data collection tools in the form of document studies. The results of the study show that there are inconsistencies and overlapping rules made by international sports federations regarding the standards of athlete eligibility criteria, causing legal uncertainty for the affected athletes. This study recommends collaboration among international sports federations in establishing eligibility criteria standards and a review of the eligibility criteria standards set to ensure inclusivity for each athlete.
