One of the problems in insurance is the rejection of insurance claims. The
lack of clarity regarding the policyholder's responsibility for losses resulting from
the rejection of insurance claims weakens the policyholder's position. The
objectives of this thesis research are: to determine the legal regulations regarding
the rights of policyholders and life insurance companies, to determine the legal
responsibility of life insurance companies in the event of a rejection of life
insurance claims, and the company's legal responsibility based on insurance law,
consumer protection law, and POJK No. 8 of 2024 for the rejection of life
insurance claims by life insurance companies.
The method used in writing this thesis is the normative law research
method, namely a method that refers to legal norms carried out by means of
literature studies to obtain secondary data in the form of primary, secondary, and
tertiary legal materials related to the problem being studied, this research has a
descriptive research nature. Drawing conclusions uses deductive drawing.
The results of this legal research show that the rights and obligations of
policyholders and life insurance companies are regulated by law, and the law
strictly protects the rights of policyholders to receive accountability from
insurance companies in the event of a denial of insurance claims that is
detrimental to the policyholder. Policyholders have the right to obtain transparent
information and submit claims legally in accordance with the provisions of the
policy. This is legally regulated in Law Number 40 of 2014 concerning Insurance,
Law Number 8 of 1999 concerning Consumer Protection and POJK Number 8 of
2024 concerning Insurance Products and Insurance Product Marketing Channels
as well as supervision from the Financial Services Authority (OJK). This provides
a strong foundation for policyholders to obtain their rights fairly and in
accordance with applicable law.
