Badan Bank Tanah sebagai Wujud Isu Domein Verklaring Pasca Berlakunya Peraturan Pemerintah (PP) Nomor 64 Tahun 2021 tentang Badan Bank Tanah

Abstract

Land is the primary source of livelihood for the Indonesian people, which is why one of our country's nicknames is the "Agrarian State." Beyond the agricultural sector, Indonesia is also rich in mining resources, including gas, oil, nickel, tin, and precious metals. Instead of creating land regulations to ensure that all our natural wealth from the land sector is managed optimally for the people's prosperity, the government has instead established rules that are more favorable to investors. The presence of the Land Bank is one example of the government's lack of commitment to maximizing land utilization for the people's welfare. As the state often neglects this responsibility in practice, and particularly concerning the Land Bank—which has drawn significant pros and cons from the public, activists, and academics due to widespread speculation that it will nationalize land and implicitly embodies the colonial law of domein verklaring—this research is deemed necessary. It aims to revitalize our critical thinking and to encourage the government to create land regulations that are aligned with the people's interests. The method used in this study is a normative juridical research method with a conceptual approach and a case approach. The result of this research aims to demonstrate that the state's responsibility for the prosperity of the people is manifested through the obligation to establish rules, laws, and land policies that are in favor of the people.
