| dc.description.abstract | Patient food procurement in hospitals is a strategic aspect that significantly affects the quality of healthcare services. Adam Malik General Hospital Medan adopted an e-purchasing method in selecting a provider, namely CV Salwa Insan Mulia. However, electronic procurement via e-purchasing presents legal challenges concerning legal compliance, protection of contractual parties, and dispute resolution in the event of default. Therefore, this study aims to examine these three issues juridically within the contract between Adam Malik General Hospital Medan and CV Salwa Insan Mulia.
This research employs a normative juridical method with statutory, conceptual, and analytical approaches. Data were collected through literature review and analysis of contract documents and relevant regulations, particularly the Presidential Regulation on the procurement of goods/services and LKPP regulations. Field interviews were also conducted to obtain practical perspectives from both Adam Malik General Hospital Medan and CV Salwa Insan Mulia as research subjects.
The implementation of the food procurement contract through the e-purchasing method reflects the application of efficiency, transparency, and accountability principles. However, the study found a need for improvement in quality control supervision, digital administrative documentation, and more detailed default sanction provisions. Based on these findings, it can be concluded that electronic procurement holds strong potential in promoting good governance, provided it is supported by clear legal frameworks and consistent implementation. Recommendations include the need for clearer dispute resolution clauses in the contract, enhancement of providers' technical capacity through regular training, and the establishment of an integrated digital internal evaluation and control unit to ensure legal compliance and contractual sustainability. | en_US |
