Analysis of the Readiness of the Legal Framework for Electric Vehicle Battery Waste Management in Supporting the Acceleration of the Implementation of the National Electric Vehicle Strategy Project
Abstract
Electric vehicles are one of the National Strategic Projections currently being worked on by the Indonesian government. The government has issued a number of regulations to strengthen the electric vehicle ecosystem. One of them is Presidential Regulation Number 55 of 2019 concerning the Acceleration of the Battery-Based Electric Motor Vehicle Program, which has been amended to Presidential Regulation No. 79 of 2023 concerning the Acceleration of the Battery-Based Electric Motor Vehicle Program (KBLBB) for road transportation. The acceleration of electric vehicles in Indonesia has resulted in a major problem, namely electric vehicle battery waste.
This thesis discusses the regulation of industrial waste in positive law, how to inventory the management of electric vehicle battery waste, and how ready the legal framework in Indonesia is to support the acceleration of the implementation of the national electric vehicle strategy project. The research method used in writing this thesis is normative legal research through library research.
Although Indonesia has a sufficient legal basis, concrete steps are still needed to strengthen the legal framework related to the management of electric vehicle battery waste. This includes the preparation of more specific derivative regulations, the application of the Extended Producer Responsibility (EPR) principle, and the harmonization of regulations between the central and regional governments. With clear and comprehensive regulations, it is hoped that battery waste management can be carried out effectively, thereby supporting the sustainability of electric vehicle projects and reducing negative impacts on the environment.
