dc.description.abstract | The criminal act of abuse committed by minors not only reflects juvenile delinquency but also highlights weak social control and the failure of the legal protection system in murturing children as perpetrators who are simultaneously victims of dysfunctional environments. Based on this phenomenon, this study seeks to answer three main research questions: (1) What are the underlying factors behind criminal acts committed by children as a form of juvenile delinquency from a criminological perspective? How is legal protection in the form of psychological legal assistance provided to children in conflict with the law? (3) What are the fudicial considerations in sentencing minors for acts of abuse categorized as juvenile delinquency, as outlined in Decision No.14/Pid. Sus Anak2021/PN.Men?
This study adopts a normative and empirical juridical approach, utilizing document studies and interviews with law enforcement officials as data collection techniques
The findings reveal that abuse by children is influenced by internal factors such as emotional instability, poor self-control, and lack of character education, as well as external factors including authoritarian parenting, social environments permissive of violence, and insufficient community supervision. Although the court opted to impose a sentence in the form of returning the child to their parents, such a measure fails to address the crucial aspect of psychological rehabilitation needed for the child's recovery. Therefore, an integrated approach combining legal, psychological, and criminological perspectives is essential to ensure a just and restorative juvenile justice process. | en_US |
