dc.description.abstract | The development of misused information technology has led to the
emergence of more modern crimes, namely online gambling. Online gambling,
which is currently being widely discussed and favored by many people, from
young to old, online gambling has a negative impact on society. Higgs domino
island is an online game site that is considered a medium for online gambling by
using it as a means of committing crimes. The problem in this study is how to
regulate online gambling crimes in the legislation in Indonesia, what are the
criminal sanctions for perpetrators of buying and selling online game chips higgs
domino island and how the judge considers the crime of buying and selling online
game chips higgs domino island in Decision Number 209 / Pid.B / 2022 / Pn Rhl.
The research used in this writing is normative research. This legal research uses
secondary data, where secondary data is data that is collected by other people,
including official documents, books and research results in the form of reports.
Qualitative normative legal research is research that refers to legal norms
contained in various laws and regulations, court decisions. The results of this
study indicate that in the application of criminal sanctions against perpetrators of
online game chips higgs domino island, only imprisonment is given and there is
no fine and the articles imposed are only Article 303 and Article 303bis of the
Criminal Code. Meanwhile, regulations regarding online gambling have been
regulated in Article 27 paragraph (2) in conjunction with Article 45 paragraph
(1) of Law Number 19 of 2016 concerning Amendments to Law Number 1 of 2024
concerning the second Amendments to Law Number 11 of 2008 concerning
Information and Electronic Transactions with the threat of imprisonment of six
years and/or a maximum fine of IDR 1,000.000.000. (one billion rupiah).
Meanwhile, for the policy of law enforcement and handling of online gambling
crimes based on the provisions of Article 13 of Law Number 2 of 2002 concerning
the Republic of Indonesia National Police, maintaining public order and
enforcing the law, and efforts made preventive and repressive efforts. | en_US |
