Analisis Hukum Tentang Tanggung Jawab Maskapai Penerbangan Terhadap Keselamatan Dan Keamanan Penumpang Dalam Penyelenggaraan Angkutan Udara

Abstract

There are several objectives for organizing flights, namely to realize safe, comfortable, orderly and economical flight operations. Airlines as air transportation service providers have an obligation to realize these flight objectives. However, in practice, there are flight cases regarding the safety and security of passengers in the implementation of air transportation. Therefore, this research was conducted with the aim of knowing and explaining the responsibility of airlines to passengers in maintaining the safety and security of passengers in the implementation of air transportation, legal protection of passengers who experience losses that arise, as well as compensation to passengers who experience safety and security disturbances in the implementation of air transportation. This research uses normative legal research methods conducted using a statutory approach and a case approach. The data collection techniques used are literature study and document study relevant to this research. Based on the discussion in this study, aviation safety and security is a top priority that must be guaranteed by airlines in accordance with various national and international legal provisions. Law No. 1 of 2009 concerning Aviation is a law that regulates comprehensively about aviation in Indonesia today, including aviation safety and security followed by its implementing regulations. In the event of an incident that harms passengers in an air transportation operation, one form of responsibility from the airline to passengers is to compensate passengers who suffer losses for air transportation operations. The airline is responsible for ensuring that the services provided meet the standards that have been set to ensure the safety, security, and comfort of passengers in the implementation of air transportation.
