This research discusses the application of the principle of Aegroti Salus Lex Suprema, which places patient safety as the highest law, particularly concerning BPJS Health patients at Grandmed Hospital Lubuk Pakam. The background of this study is the persistence of discriminatory practices in the provision of healthcare services to BPJS patients, which contradicts the aforementioned principle. The objectives of this research are to analyze the regulatory basis of the principle, identify the obstacles faced by physicians in its implementation, and evaluate the efforts that may be undertaken to overcome such challenges. The research method employed is normative legal research supported by field research with a descriptive character. The approaches applied include the statutory approach and the conceptual approach. The data sources consist of primary data obtained from interviews, and secondary data in the form of primary, secondary, and tertiary legal materials collected through a literature review. Data collection techniques involve both library research and field research, using document study and interview guidelines as instruments. The data were analyzed qualitatively through deductive reasoning, moving from general propositions to specific conclusions in order to address the research problems. The findings of the study indicate that the principle of Aegroti Salus Lex Suprema has a legal basis under Law Number 17 of 2023 concerning Health, which explicitly emphasizes patient safety as the highest priority. The implementation of this principle at Grandmed Hospital Lubuk Pakam still encounters several obstacles, including limited healthcare facilities, the high workload of physicians, and the complexity of BPJS administrative procedures, all of which affect the quality of healthcare services. Efforts that can be undertaken to address these challenges include enhancing hospital capacity, providing empathetic communication training for medical personnel, as well as improving the referral and queue management systems of BPJS services so that the principle may be optimally realized.
