Batu Bara songket fabric is a unique Malay cultural heritage that has long been an integral part of the cultural identity of the people of Batu Bara Regency. With its unique motifs and traditional weaving techniques passed down from generation to generation, this fabric not only reflects high aesthetic value, but also has significant economic potential, both locally and nationally. However, amid the changing times and the tide of globalization, songket fabric artisans face serious challenges, particularly regarding the weak legal protection of their work. Piracy, unauthorized copying of motifs, and the arbitrary use of designs by other parties have harmed artisans both morally and economically.
This study aims to address the urgent need for an analysis of the appropriate form of legal protection for Batu Bara songket fabric from the perspective of Intellectual Property Rights (IPR). The approach used is normative juridical, reinforced by field studies to explore the realities faced by artisans firsthand. The main objective is to determine the extent to which the applicable legal system, particularly Law No. 28 of 2014 on Copyright, is able to provide effective protection for this local cultural work.
The research also focuses on mapping the structural and cultural obstacles that hinder the protection process, ranging from the lack of legal literacy among craftsmen to the complexity of the legal system.
