| dc.description.abstract | Commercial karaoke events held by fan communities have become a growing
cultural phenomenon in Indonesia. These events often involve the use of
copyrighted music and songs in public settings, sometimes with commercial
elements such as ticket sales, merchandise, or sponsorship. Such practices raise
legal concerns regarding the use of copyrighted works without proper
authorization. This research aims to analyze the legal protection afforded to
songwriters whose works are performed or played in community-based karaoke
events, particularly under the provisions of Law Number 28 of 2014 on Copyright.
This study uses an empirical juridical approach, focusing on statutory analysis and
supported by primary data collected through interviews with event organizers,
venue managers, and representatives from Collective Management Organizations
(LMKs). The research also applies statutory and conceptual approaches, with data
processed through qualitative analysis and conclusions drawn deductively.
The findings reveal that many fan-based community organizers are unaware of their
obligations regarding music licensing and royalty payments. This creates a legal
gap between regulation and practice. In Indonesian copyright law, performing
rights are part of a songwriter’s economic rights, and any public use of music
including karaoke performances—must be licensed and compensated through
LMKs and the National Collective Management Organization (LMKN). Therefore,
greater legal awareness and accessible licensing mechanisms are crucial to ensure
the protection of songwriters in public and commercial uses of their work. | en_US |
