Tindak Lanjut Putusan Mahkamah Konstitusi Atas Suatu Pengujian Undang-Undang oleh Pembentuk Undang-Undang

Abstract

Non-self Implementing ruling, in its judicial verdict, tells legislature to correct or perform improvement for the reviewed law. Consequently, in the post-acceptance of the ruling, the next process is that the legislator follows up the ruling. The problem arises when the legislature does not follow up the ruling which has been stated by the Constitutional Court in its judicial verdict; the legislature even interprets it differently out the ruling The research uses juridical normative method with statute approach and the Constitutional Court ruling. It also uses literature materials such as books, journal, and other legal materials. The data are organized systematically and analyzed qualitatively in order to get the clarity of the subject matter The research conclusion is that legislature as an address at following up the Constitutional Court ruling should pay serious attention to the legal message or regulation made by the Constitutional Court in its legal consideration and in its judicial verdict as a direction in implementing the ruling. The legislature should also give time limit or firm postponement in its imposition, along with filling out the date, month, and year in its judicial verdict which contains non-self implementing content by legislature.
