The existence of spatial and zoning of Medan city should not be separated from element of building permit. The building permit itself also serves as a regional retribution but also aims to design the building in accordance with the city spatial plan and to maintain the reliability of the building that meets the administrative requirements and technical requirements in accordance with the function of the building. Furthermore, another purpose of building permit is to organize, control, and supervise the construction activities in the area. It is in accordance with Article 2 and Article 3 of Medan City Regional Regulation no. 5 Year 2015 About Retribution of Building Permit. Therefore, it is necessary to examine the relationship between the national spatial layout and the spatial layout. The process of building permits in the Office of Spatial Planning and Tata Building Medan is published. The rights and obligations of the people whose land is affected by the detailed spatial plan. This research is a normative research, and is analytical descriptive that describes as well as analyzing a phenomenon associated with the preparation of Spatial Detail Plan and Zoning Regulation as the Guidance of Issuance of Building Construction Permit for Medan City. Spatial relations with the national spatial layout is the national spatial use for the preparation of spatial layout both in regulation and implementation. Regarding local governments that do not comply with the national spatial plan, no sanctions are given, but if people who do not comply with the spatial plan, the sanctions given in the form of a written warning; Temporary suspension of activities; Temporary suspension of public services; Closing location; Revocation of permits; Cancellation of permits; demolition of buildings; Recovery of space functions; or administrative fines. The process of building permit letter in the Office of Spatial Planning and Building Medan is published through several stages, namely There are persons, meaning there is a legal or personal subject and the body obtains IMB, IMB is granted to the land designated area in accordance with the city spatial plan and Technically fulfill the provisions of the city spatial plan and fulfill the requirements of building reliability, the applicant of the permit which has fulfilled the above requirement, the official shall stipulate the IMB decision and the determination of the IMB decision shall be issued no later than 14 (fourteen) working days since all the requirements are declared complete. Rights and obligations of the people whose land is subject to a detailed spatial plan in which the reimbursement process is good and correct so as not to cause a dispute. This illustrates that the community land enters the designation of the public interest.
