Peran Ketua Adat (Raja Bius) Dalam Penyelesaian Sengketa Batas Tanah Di Desa Parbotihan Kecamatan Onan Ganjang Kabupaten Humbang Hasundutan

Abstract

Land boundary disputes in Parbotihan Village, Onan Ganjang District, Humbang Hasundutan Regency are generally caused by unilateral claims by certain indigenous groups, unclear customary land boundaries, and a lack of community understanding of their customary rights. In this context, the Customary Leader (Raja Bius) plays a crucial role as a mediator and solution provider in the dispute resolution process through deliberation and customary approaches. However, various internal and external obstacles exist, such as the emotional state of the disputing parties, low levels of education, indiscipline, and third-party intervention. To overcome these obstacles, Raja Bius seeks resolution through mediation, negotiation, and possibly formal legal channels. As a future improvement measure, it is recommended to increase the understanding of land issues among the Raja Huta through outreach and dialogue with authorities. Furthermore, the establishment of a Regional Regulation (Perda) specifically governing customary land is crucial to provide legal certainty, avoid conflict, and strengthen the protection of the rights of indigenous communities.
