| dc.description.abstract | Developers play an essential role in the construction and management of
property projects, including apartments, which require legal certainty and the
protection of buyers’ rights. However, in practice, irregularities often occur, such
as the addition of furniture and the imposition of extra costs without prior
agreement with buyers. Such actions raise legal issues because they violate the
principles of consensualism and good faith in contract law. This study aims to
analyze the legal responsibility of the developer for adding furniture without the
buyer’s consent at Cambridge Apartment Medan, to examine the form of dispute
resolution undertaken, and to understand the legal basis used in determining the
developer’s responsibility toward the buyer.
This research employs a normative juridical method with statutory and case
approaches. Data were obtained through library research, which includes primary,
secondary, and tertiary legal materials, complemented by interviews with relevant
parties. The data were analyzed qualitatively using a deductive reasoning approach
to assess the conformity of the developer’s actions with the provisions of contract
law and consumer protection principles.
The results show that the addition of furniture and the imposition of costs
without the buyer’s consent constitute a violation of the principle of agreement in
contract law. The developer bears civil liability to restore the situation to its
original state before the violation occurred and to refund the costs incurred. The
dispute between the developer and the buyer was resolved through independent
negotiation, resulting in a written agreement under private deed. This study
highlights the importance of upholding the principles of justice and legal protection
for consumers in property transactions to prevent inequality between developers
