| dc.description.abstract | The problem of spreading False News/hoax occurs in almost all countries in the
world including Indonesia. One of the hoax cases that occurred in Indonesia is the spread of
false news that occurred in the province of North Sumatra which is mostly through social
media. As a result the spread of false news (hoax) that is spread has an impact that can
damage human-to-human relationships in socializing. The formulation of the problem in this
thesis is: How is the Criminal law formulation policy regarding the criminal act of spreading
hoax news carried out during the Covid-19 pandemic in the legal system in Indonesia; How
is the Application of criminal law policy in tackling the spread of false news (hoax) during
the Covid-19 Pandemic at the North Sumatra Regional Police; How are the Obstacles in
tackling the spread of false news (hoax) during the Covid-19 Pandemic carried out by the
North Sumatra Regional police.
The method used in writing this thesis is the normative juridical research method,
namely the method that refers to legal norms with data sources obtained by researching
library materials in order to obtain secondary data in the form of primary, secondary, tertiary
legal materials. The nature of this research is prescriptive, by using data collection
techniques namely library research. Data collection tools use document studies, and
interviews were conducted with Police at the North Sumatra Regional Police.
Research Results Show the Criminal Law Formulation Policy in Tackling criminal
acts of false news during the covid-19 pandemic is regulated in laws and regulations in
Indonesia namely, In the Kuhp (Criminal Code), Law No. 1 of 1946 concerning Criminal
Law Regulations, Law Number 19 of 2016 concerning amendments to Law Number 11 of
2008 concerning Electronic Transaction Information (ITE), Law no 1 of 2023 concerning the
new Criminal Code. The application of criminal law policies in tackling criminal acts of
false news or hoaxes during the covid-19 pandemic at the North Sumatra Regional Police
applies the legal basis regulated in the ITE Law namely Law Number 19 of 2016 concerning
Electronic Information and Transactions. Inhibiting factors for the eradication of false news
(Hoax) in the legal area of the North Sumatra Regional Police are Legal factors, Law
Enforcement factors, Facilities and Infrastructure factors, Community factors and Cultural
