Pelaksanaan Rahasia Dagang di Kawasan Industri Medan (KIM) I

Abstract

Indonesia is one of developing countries that is targeted in the application of Intellectual Property Rights (IPR) along with the increasing development of the country's economy in the fields of trade, industry, and economy, particularly in Southeast Asia. As the third largest city in Indonesia by economy Medan has an industrial area known as KawasanIndustri Medan (KIM) I which is filled with various facilities for industrial activities, business, modern trade and professionally managed. Trade secrets is one type of the intellectual property rights which is protected by the state law and legislation in Indonesia. In the development of trade and industry, it is not only related to goods and services exclusively, but also it involves other resource in the form of useful information for businesses and has high economic value in business trade and industry activities. Violation of trade secrets would be very detrimental to the inventor / owner of IPR. The Protection of trade secrets is an absolute condition, because it is a very essential factor in competition efforts. The purpose of this study is first explain the legal protection of trade secrets and its relation with industries in Indonesia. Secondis explain the working mechanism of the industry in maintaining/protecting the trade secret that associates with the industry in Indonesia. Third As well as to explain whether the industrial area has provided adequate legal protection against any trade secrecy that operate in Medan Industrial Area. Law of Normative - Empirical, with a descriptive study; describe and analyze the facts of the implementation of Trade Secrets in KawasanIndustri Medan (KIM) I. This research uses three approaches i.e. legislation, Conceptual, and Case. The protection of trade secrets is given automatically (without registration) and it is given as long as the confidentiality is maintained and not announced. Guaranteed in the Constitution of the Republic of Indonesia No. 30 of 2000. Article 2 UURD, states: The scope of protection of trade secrets include methods of production, processing methods, sales methods, or other information in the field of technology and / or business that has economic value and is not known by the public in general. To maintain the existence of a trade secret the owner has to undertake concrete steps to protect it. As a developing country, Indonesia, needs to create and support fair and open competition in the business world, so it is in line with the conditions in the fields of trade, industry, investment, and business. To date, there are many who still don’t want to disclose their findings or inventions, because they want to maintain the confidentiality of their intellectual work through trade secret practice. In Indonesia, the issue of confidentiality is regulated in several separate rules, which is not yet as a unified system of rules.

Indonesia merupakan salah satu negara berkembang yang menjadi sasaran penerapan Hak Kekayaan Intelektual (HKI) beriringan dengan meningkatnya pembangunan perekonomian negara dalam bidang perdagangan, industri, dan ekonomi khususnya di Asia Tenggara. Sebagai kota ketiga terbesar di Indonesia berdasarkan perekonomiannya Kota Medan memiliki sebuah kawasan industri yang dikenal dengan nama Kawasan Industri Medan (KIM) I dengan beragam fasilitas kegiatan industri, bisnis, perdagangan yang modern dan terkelola secara profesional. Rahasia dagang merupakan salah satu bentuk dari hak kekayaan intelektual yang diberikan perlindungan oleh pemerintah melalui peraturan perundang-undangan di Indonesia. Dalam perkembangannya masalah perdagangan dan industri tidak hanya berkaitan dengan barang dan jasa semata-mata, tetapi di dalamnya juga terlibat sumber daya lain berupa informasi yang berguna bagi kegiatan usaha dan bernilai ekonomi tinggi dalam menjalankan kegiatan usaha industri maupun perdagangan. Tujuan penelitian ini adalah Pertama menjelaskan perlindungan hukum rahasia dagang industri dan kaitannya dengan bidang industri di Indonesia. Kedua menjelaskan mekanisme kerja industri dalam menjaga / melindungi kerahasiaan dagang yang berkaitan dengan industri di Indonesia. Ketiga menjelaskan kawasan industri dalam memberikan perlindungan hukum yang memadai terhadap kerahasiaan dagang setiap industri yang beroperasi di dalam Kawasan Industri Medan. Perlindungan terhadap rahasia dagang diberikan secara otomatis (tanpa pendaftaran) dan diberikan selama kerahasiaan terjaga dan tidak diumumkan. Terjamin dalam Undang-Undang Republik Indonesia Nomor 30 Tahun 2000. Pasal 2 UURD menyatakan: Lingkup perlindungan rahasia dagang meliputi metode produksi, metode pengolahan, metode penjualan, atau informasi lain di bidang teknologi dan/atau bisnis yang memiliki nilai ekonomi dan tidak diketahui oleh masyarakat umum. Untuk mempertahankan eksistensi rahasia dagang maka pemilik rahasia dagang harus melakukan langkah-langkah konkret untuk melindunginya.Di Indonesia, masalah kerahasiaan itu terdapat di dalam beberapa aturan yang terpisah, yang belum merupakan satu sistem aturan terpadu.
