Tuntutan terhadap kesadaran atas perlindungan, penghormatan, penegakan,
pemenuhan, dan pemajuan HAM merupakan komitmen dan tanggung jawab negara.
Bentuk kesadaran etis tersebut diwujudkan dan di normakan dalam bentuk Peraturan
Presiden Nomor 75 Tahun 2015 Tentang Rencana Aksi Nasional Hak Asasi Manusia
sebagai penjabaran dari Vienna Declaration and Programme of Action June 25, 1993
(Deklarasi dan Program Aksi Wina 25 Juni 1993). Pelaksanaannya turut menjadi
tanggung jawab Pemerintah Daerah Provinsi, Kabupaten/Kota dalam menangani
pemasalahan HAM yang bersifat lokal. Penelitian ini difokuskan pada Kebijakan
Hukum Pemerintah Daerah Provinsi Sumatera Utara dalam pelaksanaan RANHAM
di daerah.
Penelitian ini menggunakan metode yuridis normatif yang bersifat deskriptif
analitis dan menghasilkan tiga kesimpulan dari permasalahan yang dibahas, yakni: 1)
Kebijakan hukum perlindungan HAM oleh Pemerintah Republik Indonesia secara
umum diatur dan bersumber pada Pancasila dan Undang-Undang Dasar Negara
Republik Indonesia Tahun 1945. Kemudian dijabarkan dalam UU No. 39 Tahun 1999
Tentang Hak Asasi Manusia, selanjutnya dilaksanakan dalam bentuk Peraturan
Presiden No. 75 Tahun 2015 Tentang RANHAM; 2) RANHAM daerah Provinsi
Sumatera Utara diatur dan direkomendasikan berdasarkan Surat Edaran Mendagri RI
No. 180/1319/SJ, yang sebelumnya diatur dan harus ditetapkan berdasarkan Instruksi
Presiden; 3) Pendanaan penerapan RANHAM di lingkungan Pemerintah Daerah
Provinsi Sumatera Utara periode 2015-2019 masih mengalami keterbatasan anggaran.
Berdasarkan kesimpulan tersebut, disarankan: 1) Perlu meningkatkan
komitmen pemerintah dengan membentuk kebijakan-kebijakan hukum nasional
perspektif HAM; 2) Penerapan RANHAM daerah Provinsi Sumatera Utara perlu
didukung dengan kebijakan hukum daerahnya dan keseriusan Pemerintah Pusat untuk
memperbaiki dan mempertegas kedudukan dan tata kelola Instruksi Presiden maupun
Surat Edaran Mendagri yang dijadikan sebagai acuan atau kebijakan peraturan
pelaksana daripada Perpres No. 75 Tahun 2015 Tentang RANHAM sebagai acuan
dan tata laksana pelaporan Aksi HAM daerah yang telah di tetapkan; 3) Penerapan
RANHAM di Pemerintah Daerah Provinsi Sumatera Utara perlu disikapi dengan
sinergitas cakupan anggaran yang lebih rasional dan memadai, serta menjalin
hubungan yang harmonis diantara Tim Aksi HAM Pemerintah Daerah Provinsi
Sumatera Utara terutama antara Kepala Daerah dengan Dewan Perwakilan Rakyat
Daerah dalam mendorong kesepahaman untuk perlindungan dan pemajuan HAM
melalui proses penyusunan anggaran daerah yang konfrehensif dan akuntabel. The demand for awareness of the protection, respect, enforcement, fulfillment
and promotion of human rights is the commitment and responsibility of the state. This
form of ethical awareness is manifested and normalized in the form of Presidential
Regulation Number 75 of 2015 concerning the National Action Plan for Human
Rights as an elaboration of the Vienna Declaration and Program of Action June 25,
1993. The implementation is partly the responsibility of regional governments both
provincial and district/city in handling local human rights issues that are focused on
the Legal Policy of the province of North Sumatera. Government in the
implementation of human rights actions in the regions.
This study uses a normative juridical method that is descriptive analytical and
produces three conclusions from the problems discussed, namely: 1) Human rights
protection policies by the Government of the Republic of Indonesia in general are
regulated and sourced from the Pancasila and the 1945 Constitution of the Republic
of Indonesia. Then it is elaborated in Law Number 39 of 1999 concerning Human
Rights, subsequently implemented in the form of Presidential Regulation Number 75
of 2015 concerning National Action Plan on Human Rights; 2) National Action Plan
on Human Rights of the province of North Sumatera is regulated and recommended
based on the Minister of Home Affairs Circular Letter No. 180/1319 / SJ, which was
previously regulated and must be determined based on Presidential Instruction; 3)
Funding for the application of National Action Plan for Human Rights in the
Regional Government of the province of North Sumatera in the 2015-2019 period is
still experiencing budget limitations.
Based on these conclusions, it is suggested: 1) It is necessary to increase the
government's commitment by forming national legal policies from a human rights
perspective; 2) The application of the National Action Plan on Human Rights area of
the province of North Sumatera. needs to be supported by its regional legal policies
and the seriousness of the Central Government to improve and reinforce the position
and governance of the Presidential Instruction as well as the Minister of Home
Affairs Circular used as a reference or implementing regulation policy rather than
Presidential Regulation Number 75 of 2015 concerning National Action Plan on
Human Rights as a reference and reporting procedure for regional human rights
actions that have been established; 3) The implementation of National Action Plan on
Human Rights in the Regional Government of the province of North Sumatera needs
to be addressed with a synergy of more rational and adequate budget coverage, as
well as establishing harmonious relations between the province of North Sumatera
Government's Human Rights Action Team, especially between the Regional Head and
the Regional Representative Council in encouraging understanding for protection
and the promotion of human rights through a comprehensive and accountable
regional budgeting process.
