dc.description.abstractABSTRACT Prof. Dr. Madiasa Ablisar, SH,MS * Dr. Marlina, SH, M.Hum * Dr. Edy Ikhsan , SH, M.Hum * Yoseph Andrian Meitianus Lase* Children are creatures of God Almighty who have human rights like other human beings, so that no human or other party may rob them of these rights. Children have a strategic role and the state guarantees the rights of every child to survival, growth and development as well as protection from violence and discrimination. Problems related to children often occur in Indonesia, for example regarding sexual abuse of children, including within the jurisdiction of the Nias Police. Most of the victims of sexual abuse are children who are still categorized as under the age of 17 years and are still students. Prevention efforts (preventive) are expected to prevent the occurrence of the crime of obscenity so that children in Gunung Sitoli City are protected from these crimes. However, these prevention efforts still have obstacles and challenges that the Nias Resort Police must face to prevent the occurrence of criminal acts of child molestation. The type of research carried out is normative juridical research by proposing legislation in conducting the study, selecting the type of normative juridical research, then this research is also supported by empirical data in which researchers conduct interviews at the Nias Resort Police (Polres) and Penitentiary Institutions (Lapas) Class II b Gunungsitoli. The factors that cause child molestation based on researcher interviews with the Nias Resort Police PPA are: gender factor, family factor, education factor, environmental factor, alcoholic beverage factor and technology factor. one of the functions of state government in the field of maintaining security and public order, law enforcement, protection, shelter, and service to the community. The role of the Police is aimed at realizing internal security which includes the maintenance of public security and order, order and law enforcement, the implementation of protection, protection, and public service, as well as the creation of public peace by upholding human rights. Efforts that can be taken in overcoming the crime of obscene acts are criminal policies or crime prevention policies, one of which can be taken through a penal policy, namely law enforcement by punishing the perpetrators of the crime. Non-penal efforts to overcome the crime of sexual abuse of minors are carried out through legal counseling to the community regarding the importance of preventing children from becoming victims of sexual abuse and efforts to obtain legal certainty if children become victims.
