dc.description.abstract | With the advent of modernization in the era of globalization, causing a consequence in
terms of economic competition. One of the things that can be done to improve the economy is to
do a business or a business. Business is a collaboration with others to achieve a common goal
which is the highest profit, which in this case of course there is an ongoing relationship with the
other party. In conducting relations with other parties necessary provisions so that cooperation
can be established with both, and goals can be achieved as expected. Therefore, the existence of
the provisions, it is necessary to the role of law in business traffic.
In recent years the concept of franchising has become one of the new trends that give
color to the dynamics of the Indonesian economy. Franchising is engagement where one party is
given the right to utilize and or use of intellectual property rights or characteristic of the
invention or a business owned by another party with a reward based on the requirements set
forth in the provision or supply of goods and or services. Because the franchise is so attractive
and profitable for small businesses or local businesses. Government deems it necessary to set the
business.
This study aims to determine how the legal protection in the implementation of franchise
business and to find out how the implementation of franchise business practice.
Form of research is normative legal research and data collection derskriptif obtained
through interview techniques and study documentation obtained directly from study sites.
Methods of data analysis techniques used are qualitative analysis through data collection both
primary and secondary, then the data obtained is then analyzed.
The study results obtained show that the Franchise Agreement in Restaurant Khas
Amerika A & W Plaza Medan Fair Medan enough legal protection given to both the franchisor
