Peranan Perusahaan Ekspedisi Muatan Kapal Laut Terhadap Pengiriman Barang dalam Pengangkutan Laut (Study Kasus di Kotamadya Medan)

Abstract

The services of an "Ekspedisi Muatan Kapal Laut (EMKL)", _as a sea transportation company, as mentioned in article 7 paragraph 1 Act. No, 21/1992 (UU No. 21 Tahun 1992) have a number of Tegal aspects. Given the roles of EWKL in shipping goods are increasing from year to year comitant with the development of Indonesiar economy, it is therefore necessary to analyze more throughly the legal aspects of the sea transportation

This research attemps to examine the following questions

1, What are roles of an EMKL Company in relation with transportating goods by ships ?

2. To what extent is the responsibility of an EMKL company if the goods are damage or missing ?

3. Are there any barrirs, technically and operational- ly, faced by the EMKL company due to the incomplete ness of the rules governing the sea transportation ?

There are three types of data collection techniques used in this study namely library research, Questionnaires, and interviews. The Unit of analysis 1s ENKL/UJPT company The sample consists of 24 EMKL/UJPT Company (10 EMKL umum, 10 UaPT and 4 EMKL khusus). In addition, data are also obtained from the Belawan port authority. This study is a legal normative research with qualitative descriptive approach. The data found in this study are presented descriptively and qualitatively and then the data are compared with the existing laws and regulation.

The research findings should that the cole of the EMKL/UJPT as an intermediary is to bridge the needs of the goods owner and the transport company. As a shipper, the role of the EMKL/UJPT begins since the goods arrives and delivered by the transport company to the EMKL/UJPT or since the EMKL /UJPT receives the goods from owner and hands them over to the transport company. Based on article 8 KUHD and SK Menhub PM 7/M/Ph.b.74 Article 4.(2).e., an EMKL/UJPT can also offers storage services.

The EMKL/UJPT companies often encounters problems in their shipping activities. Some of the problems are missing or damage goods, shringkage, late arrival, less. quantity, late loading or unloading, etc. All of these problems certainly bring losses to the goods owners.
