The transportation agreement requires the transporter
to keep the safe of goods carried starting from the
harbor loaded them in up to the one hundred them over.
This agreement is also in effect for any passenger getting
on the ship.
As well as the mentioned responsibility, the
transporter has to pay compensation of any damaged a lost
goods or injured passenger caused by the shipping
companies during the sailing.
To know to apply transporter's responsibility to the
transport by using ship serving inter-ports in Nias
regency, the writer has conducted research at Gunung
Sitoli port, Teluk Dalam port, Sirombu port, Lahewa Port,
Pulau Tello and Sibolga ones. The owners or the manager
of shipping companies, ship's captains, and the relating
governmental departments were the writer's respondents in
this research.
The existing outcomes of the research are as follow:
1. The existing shipping companies in Nias regency, acting
as transporters, realize their responsibilities for the
safety of goods and passengers carried in.
2. The transporters admit to· take responsibilities to
pay compensation on any damaged or lost goods as well
as the injured or wounded passengers caused by the
shipping companies during the sailing after priorly being proved who's guilty is it and the Passengers have
to be insured by the transporters.
3. The transporters do not have deeply knowledge for some
applied regulations to the relating sea transportations
such as the articles of Civil Codes,
Codes of Business Law, Shipping Law, the Governmental
Regulation and so forth.
