Peranan Pemerintah daerag Provinsi Sumatera Utara dalam Pengelolaan Untuk Menjaga Fungsi Pelestarian Daerah Aliran Sungai (Studi Sungai Deli)

Abstract

River basin is- an ecosystem unity that consists of natural resources of land water, vegetation and human resources as user of the natural resources. The river basin of Deli River is a poor condition. The sedimentation in Deli River is damaged caused by waste and mud. The waste and mud carried out by flood, because the upper stream of the river has been shallow, and erosion caused by the reforestation crisis in river basin.

This research aims to study the role of Local Government of North Sumatera Province in manage and preserve the conservation function of river basin of Deli River. This research is a normative juridical study. The library and document are the main sources of data while the field data by interview will be a support data. The collected data is separated and analyzed by qualitative method.

The result of study indicates that the rule in management of the river basin of Deli River refers to Act No. 7 of 2004 concerning to Water resources, Government Regulation Nio. 82 of 2001 concerning to Management of Water quality and Water Pollution control and/or Act No. 35 of 1991 concerning to the river and another one Such as the Rule of Forestry Minister of RI No. P-39/Menbut-1/2009 concering to Guidance for Integrated Management of river basin. The obstacle faced by government of North Sumatera in the river basin management is there is not. the rules and regulation for implementation as the legal base that regulate the river basin of Deli River especially as a juridical base in do the management and there is not a coordination between area and inter-sector in addition the lower of fund for the management of river basin of Deli River. The role of government of North Sumatera province in the river basin management of Deli River is by the enforcement of the environment act to the businessman or any sides who damage the river basin. For the supervision in management, the government of North Sumatera establish a Communication Forum for Management of river basin and specially for river basin of Deli River, it had established the Communication Forum for Management of river basin of Wampu, Deli and Ula rivers.

It is concluded that in management of river basin specially river basin of Deli River, government of North Sumatera has not yet a special rule about the river basin of Deli River in which in its implementation, there are any obstacles either in the law enforcement and the lower of society awareness in preserve the environment specially the river basin.
