Eksistensi Komite Medis dalam Pengelolaan Rumah Sakit Umum di Kota Medan

Abstract

In managing general hospital, the existence of Medical Committee according to KEPMENKES RI No. 983/Menkes/SK/XI/1992 is intended to protect patient rights over a good and high quality, of health service to obtain this, Medical Committee has an authority to organize the duty of doctors in providing health services by developing health service standard, as well as conduct monitoring and controlling toward the implementation such as carrying out the Medical Audit. The importance of the existence of Medical Committee in general hospital in Medan city because many of medical error or negligence from the medical doctor are often taken place of their patient these can be inflict a loss to the patient there for some of patient propose are looking for a justice accusation to the district court. Based on this reason, it is necessary to search and analysis the existence and the importance's of Medical Committee role, method and procedure in implementing Medical Committee and the accountability the implementation of Medical Audit towards accountability of medical doctor on medical error or negligence. This study is analytical descriptive research with normative and sociological jurisdiction approachment. The research, was taken place in Medan city, sample was determined purposively such as H. Adam Malik Medan Hospital, Dr. Pirngadi Medan Hospital, St. Elisabeth Hospital and Haji Medan Hospital. Respondent was also determined purposively, 1 person from top management, 2 medical doctors from Medical Committee and 20 patients from each hospital. Secondary data was collected through library research, while primary data was obtained through question in interview. Collected data was interpreted and analyzed as descriptive analytical qualitative specially on medical document and non medical document. Based on the research, it can be concluded as follows: 1. In 41 (forty-one) general hospital in Medan city, the existence of Medical Committee was abiviously neglected by the owners or manager of general hospital. While the existence of Medical Committee on the 4 (four) general hospital such as the legal procedure and basic and the organization structure legally have fulfilled all the law requirement and their formation are based on the protection on patient rights over a good and high quality of health services. 2. The role of Medical Committee to protect their patient as the consumer in Medan city is created variously, i.e., standard of medical service, evaluated the success and failure of medical action, built the profession medical ethics and maintenance it's disciplinary to their member and implemented the hospital regulation on medical functional staff and carried out the regulation aa a compass. Although various Medical Committee roles mention has been carried out functionally, technically and administratively, however the role of Medical Committee in the 4 (four) general hospital in Medan city has not conducted maximally. 3. Legally, in accordance with principle between employer and employee and also in KUH Perdata as well as jurisprudence of supreme court of Republic of Indonesia No. 558/K/Sip/1971 and decision od district court of Sukabumi No. 40/PDT/G/1986.PN.SMI, Medical Audit carried out by Medical Committee in general hospital cannot release the general hospital from the responsibility of medical error and negligence conducted by the medical doctor in the general hospital. Suggested provided to revised KEPMENKES RI No. 983/Menkes/SK/XI/1992 and several regulations above, about obligation to form the Medical Committee as well as regulation holds and applies a sanction for general hospital when formed Medical Committee. There for such as law staff with law education general hospital in Medan to involve another professional staff from external in the Medical Committee in their general hospitals management. Furthermore, and also to make it easy for general hospital to understand and follow up the procedure and substance of law to monitor and controlled the doctor duty in Indonesia
