Abstract

The Local Government of Langkat District enacted the Regent's Decree No. 62/2008 on the Management of Licensing and Authorizing a Part of the Authority of Signing the Draft of Licensing and Non-Licensing to the Head of the Integrated Service Office of Langkat District. The Disturbance License was stipulated in the Regional Regulation of Langkat District No. 36/2002 on the Retribution of Disturbance License. The Environmental Impact Control Office of Langkat District in its environmental law enforcement should be able to protect and to manage environment in order to help the Regent run the government in controlling the environmental impact. The problems which would be discussed in this thesis were whether the government of Langkat District, in giving Disturbance License, had considered the aspect of environmental protection and how the government of Langkat District controlled the implementation of Disturbance License which was related to the environmental protection. The research used judicial formative method which was referred to the norms and legal principles found in the legal provisions. It was doctrinal research which analyzed the law as the method of research in the application of the regulations of local government in giving the license. In giving the Disturbance License, the government of Langkat District has considered the Environmental Protection. It can be seen in the regional regulations enacted by the government of Langkat District that regulated the aspect of the environmental protection in giving the Disturbance License. The Regional Regulation of Langkat District No. 36/2002 on the Retribution of Disturbance License was enacted in order to implement Law No. 18/1997 on State and Local Taxes and Local Retribution, i.e., the regional regulation related to the use of assets which was needed to be adjusted. This regulation was enacted in order to protect the public interest and environment which were potential to danger, loss, and disturbance to people and environment. The control on the implementation of the Disturbance License by the government of Langkat District is related to the Environmental Protection conducted by the Environmental Impact Control Office of Langkat District through its control function. The Environmental Impact Control Office of Langkat District is one of the instruments of the government of Langkat. District in law enforcement which has to protect and manage the environment in order to help the Regent run the government, especially in controlling the environmental impact.
