Kewenangan Legislasi Komisi Pemilihan Umum Daerah dalam Pemilihan Kepala Daerah Langsung Tahun 2005 (Studi Kasus pada Komisi Pemilihan Umum Kabupaten Tapanuli Tengah)

Abstract

The General Election Commission have become a compulsion of the election in democratically maintain the equallity, free, secret and square so that give the legislation authority which can take care of its independency. But, Experince of execution PILKADA in various area disturbing of legislation authority of General Election Commission in PILKADA management, in this case is election of Regional Leader in Tapanuli Tengah.

To know the legislation authority of General Election Commission relied on Tapanuli Tengah of descriptive method with the data source in the form of entire document related to execution PILKADA in Tapanuli Tengah. Analysis Method used is descriptive method.

Result of research indicate that the legislation authority of General Election Commission full Tapanuli Tengah have been executed according to law and regulation. Legislation Authority of General Election Commission of defensible Tapanuli Tengah Election, when existence of pressure from various party related to write-off one of couple of candidate of Regional Leader and Regional Leader Proxy. General Election Commission finally over a barrel face the strength and influence in the form of intervention of central government and province government. Legislation authority owned by the General Election Commission in the case of determination of balloting schedule finally fail with the inexistence letter of licence from Sumatera Utara Governor. This prove that threat of independency of General Election Commission, exactly stem from governmental intervention.
