Abstract

Until now Pandhuisreglement Staatsblad 1928 number 81 as Aturan Dasar Pegadaian (A.D.P.) is still valid. Article 6 of this ADP regulates the object of pawn as the same as article 6 in the statue book which controlled systematically pawn house before: easily, justly and without difficulty fixes object of pawn, for: 1. Written information about pawns object is relatively short. 2. Competence is doubtful to refuse good in spite of it belongs to the category of legal pawns articles. 3. Anticipation of pawn house in accepting good as legal one is unknown. The analytical descriptive research gets facts by interview, observation and questionnaires from 54 persons taking in purposive as pawn houses in Kotamadya Medan. The problem solving Perum Pegadaian has the duty: 1. Economic-juridical aspect. To complete the written information with unwritten ones because article has to have economical value to the local is non scriptum. 2. Utility-juridical aspect. To take only article as pawn which attractive and or useful to people in its operation region. 3. Philosophy-juridical aspect. To put anticipate policy in accepting article as legal pawn, by creating rules about: a. Appreciate the loyalty of the employers. b. Fix good relation among the employers. c. High employers upgrade and educate the lower employers. All these aspects are important to realize KUH Perdata Pasal 1150.
