Beberapa Faktor Penghambat untuk Meningkatkan Invenstasi di Bidang Pertambakan di Percut Sei Tuan Kabupaten Deli Serdang Ditinjau dari Undang-Undang Pokok Agraria dan Undang-Undang Penataan Ruang

Abstract

The more population we have, the needed of land seem to be larger increasing request either housing, to fulfill the needed of life by using the land or the things which have related with it. The preference problem in using the land is to fulfill the needed of live, that must be followed by the structuring system of the land which is adjusted with the space structuring together with the effort done by the society. Reality shows that the needed of full concept regarding the used of land so it can make the more useful for the society prosperity themselves In relation with this problem, Government as the authority wants the planning concept made by him to be adjusted by the advantages done by the society, besides that the society should try to use it without seeing the signal decided either in legislation regulation or policy issued by the local government This research to be meant for knowing the arrangement role for Land Regulation (UUPA) and Arrangement Space Regulation (UUPR) for fishpond effort done by the society, which disrelation with the establishment pattern and job scheme developed by that society. The system of this research is Descriptive Analysis. Descriptive means that because of this research to be hoped to get the whole images and systematic for the process of the fishpond effort according to the Land Regulation (UUPA), Arrangement Space Regulation (UUPR) and provide for a place of job scheme. Analysis because of the main interpretation to be used is the legislation regulation by using the way of interpretation

to the norm and theory of existing law. The result of research shows the following: a) the arrangement of Land Regulation (UUPA) to the fishpond problem will be created form the arrangement of property right (hak milik), water useful right (hak guna air), the right for maintenance is and the arrangement of authority, property and land care which are used in fishpond effort. b) the arrangement of UUPR for the problem of fishpond is by the structuring and useful of space and controlling of the land used, so it will be adjusted with the Planning of Areas Space (RTRW) planning which is carried our or made by the local government with what have been done by the society. c) the establishment pattern for fishpond effort done with the investment pattern, loan system, elucidation and creation so it can make the maximal result besides hoping by using the organization of cooperation effort which is apart in increasing the undergo effort.
