Perjanjian Bagi Hasil Tanah Pertanian di Kabupaten Ogan Komering Ilir Propinsi Sumatera Selatan
Abstract
Share cropping is Adat Law institution which is still alive in society. Nowadays, it is still needed whenever agricultural sector has important meaning to support economic society concerned. the purposes of this research are to answer the question about share cropping agreement according to Ogan Komering Ilir society, the background of this agreement, forms and contents as well as conditions of agreement, share cropping object, role of village chief in share cropping agreement and principles to take out in share cropping agricultural agreement.
The title "The Share-Cropping Agreement of Land Agricultural in Ogan Komering Ilir Regency South Sumatera Province", is a qualitative research using jurisdictional sociological method. The respondents are selected on the basis random sampling for sixty respondents.
This research is done by spreading questionnaires and doing direct interviews to respondents. The data obtained are processed quantitatively in the form of frequency table with using deductive and inductive method and are discussed qualitatively by comparing Adat Law theories and valid regulations.
The result of study in Ogan Komering Ilir Regency shows that the greater part of share cropping agreement is not written but based on mutual believe in the parties, which makes it possible for land owners to allow cultivation of his land by giving half the harvest or the share based on customary law. The background of share cropping agreement are the land owner has no time or not able to cultivate his land. The form of agreement is mainly not written with the following conditions; the consensus of opinion, adult, permission from land owner for cultivation and his share of a half harvest. Share cropping objects are plants through the year, second crop and plants of a year. The dispute settlement of the parties can be dissolved by them, without participation chief of village. The principles found in share cropping agreement are consensus principle, mutual believe principle, harmony principle, discuss principle and principle that whoever cultivates the land has to share half harvest to land owner.
