Pelaksanaan Undang-Undang No. 2 Tahun 1960 Tentang Bagi Hasil Tanah Pertanian di Kabupaten Daeerah TIngkat II Agam Propinsi Sumatera Barat

Abstract

Production sharing Contract happened because the owner of land would like to get the production of his land. The owner would like to use the land but he can not manage it. In this case the land is given to other people in handling it with the agreement of production sharing contract. This agreement this done orally based on the agreement between the owner and farmer. This contract can cause the uncertainty of law and there will be the extortion toward low class (farmer). In order to anticipate this case, the Government issued the law No. 2 of 1960 which is aimed that production sharing is done with the principle of Justice between the owner and farmer. It is as a clause of the law No. 2 of 1960. Production sharing contract is the contract which is made in written from before the village head, the witness as well as legalized by the head of district. In its implementation there are some problems such as the obstacle. For this, the research is done concerning with the implementation of Law No. 2 of 1960 and take the location in Agam Region. The research is descriptive analysis. The respondent is taken purposively with the total number 120 respondents consisting of 30 respondents of the owner and 90 respondents of the farmer. The data were obtained through questionairre and interviews. The result of this research shows that the law No. 2 of 1960 was not implemented well because the respondents implement production sharing contract orally on the agreement of both parties.
